Terms of Use & Service Agreement
Effective Date: September 2026 · Contracting Entity: WIK Technologies Limited
01Parties & Acceptance
These Terms of Use constitute a legally binding agreement between WIK Technologies Limited ("Provider", "Company") and the wireless internet service provider, network operator, or enterprise tenant ("Tenant", "Operator") accessing or utilizing HotBill KE software, APIs, and cloud services. Accessing the NOC console or connecting hardware to the HotBill API denotes full acceptance of these terms.
02Platform Service Scope
HotBill KE provides automated infrastructure orchestration comprising:
- Real-time Safaricom Daraja M-Pesa STK Push billing dispatcher and callback webhook processor.
- MikroTik RouterOS binary socket API controller (port 8728) for user lifecycle and bandwidth queues.
- Sub-50KB zero-dependency captive portal distribution engine for mobile hotspot authentication.
- Operator NOC administration dashboard for live telemetry, voucher batch generation, and revenue auditing.
03Operator Responsibilities & Legal Compliance
The Operator represents and warrants that:
- They hold all requisite telecommunications licenses and spectrum permits issued by the Communications Authority of Kenya (CA).
- They will maintain RouterOS equipment in a hardened, updated state with strong credentials.
- They will not route illegal, infringing, or malicious traffic across HotBill KE gateways.
- They are solely responsible for setting accurate retail package pricing and end-user customer support.
04M-Pesa Settlements & Tenant Kill Switch
Customer payments initiated via STK Push settle directly into the configured tenant Safaricom Paybill or Till Number. Software usage fees, gateway commissions, and subscription charges are recorded in the HotBill settlement ledger.
05Service Availability & Limitation of Liability
While HotBill KE strives for 99.9% core gateway uptime, WIK Technologies is not liable for service interruptions arising from upstream telecommunications provider outages (including Safaricom Daraja maintenance), local electrical failures, fiber cuts, or unauthorized modifications to client MikroTik hardware.
06Governing Law & Commercial Inquiries
This Agreement is governed by and construed under the laws of the Republic of Kenya. All legal disputes shall be resolved under the jurisdiction of the commercial courts in Nairobi, Kenya.
